Wagners can pursue defamation case against Channel 9

A SUPREME court justice has given Toowoomba's Wagner family a green light to continue with one part of their defamation case against Channel Nine.

The Wagners have claimed a 60 Minutes episode about the 2011 Grantham floods defamed them because it implied they caused the devastation of Grantham and deaths of 12 people.

The Wagners owned a quarry that was investigated for possible links to the flood but an inquiry last year found the quarry had no significant negative impact on the tragedy.

The TV network sought to have these claims struck out at Brisbane Supreme Court, arguing the imputations could not have arisen out of the 60 Minutes episode.

Today Justice David Boddice ordered three claims be struck out but ruled the one of the claims could proceed.

The Wagners can proceed with an allegation the program implied the family sought to conceal the truth from being known about the role the quarry played in the floods.
