Notebook director claims ex won’t return his daughter

NICK Cassavetes is going after the mother of his daughter after she allegedly violated a custody agreement.

The Notebook director, 58, is accusing Heather Wahlquist of keeping their daughter for longer than their custody agreement permits, TMZ reported.

Cassavetes claims their 13-year-old daughter Barbie was supposed to return to Los Angeles on December 18 (and he would have custody through to January 8), but the teen is still with Wahlquist, 40, in Oklahoma.

Cassavetes is now going after Wahlquist's mother and aunt "for allegedly conspiring with Heather to steal his child" and wants $10,000 in penalties, with the amount increasing each day his daughter is kept away from him. Case information shows the motion to seek damages was filed on Friday.

"My 13-year-old daughter Barbarella Cassavetes has gone missing, her mother repeatedly ignoring and disobeying court orders and stipulations," he said on Monday. "Heather Wahlquist is on the run, refusing to let me see Barbie, ignoring mandatory court appearances, and evading law enforcement."

However, Wahlquist's mother Linda Massad, told TMZ that Cassavetes "wants revenge".

"You have no idea what he's done," she told the site in an emotional video. "He wants revenge against my daughter, it's not about his child … He told her when she left, 'I will make your life a living hell.'"

The ongoing battle first started in November according to court documents when Wahlquist filed a protective order against Cassavetes. Wahlquist told TMZ on Tuesday that her former husband has been a bully and she took her child away from him out of fear. She also alleges that he struggles with substance abuse.

The estranged couple met in 2002. Wahlquist played best friend to Rachel McAdams in The Notebook.

A rep for the director had no comment.
