Mother pleads for shorter sentence

THE mother of a Gold Coast man serving 18 years jail for fatally shooting his friend in the chest pleaded with a judge not to extend his time behind bars.

Madeleine Lacey, in letter to the Brisbane Supreme Court, said any more jail time for Dionne Matthew Lacey, 25, would crush the "life he has to live".

"He is a model prisoner. He is doing the utmost every day," she said.

But Justice Anthe Philippides said Lacey had been involved in another gun incident when he and friends robbed three people.

She said a bullet had grazed a victim's calf before hitting the floor.

Lacey also had trafficked ecstasy, cocaine and cannabis between January 15, 2006, and May 28, 2007.

The court heard he trafficking in quantities of drugs worth a few thousand dollars up to $30,000 a transaction.

Defence barrister John Fraser had argued the Crown's submission, that Lacey serve more time, would be "unduly crushing" on a man who was aged 19 and 20 when he committed the offences.

"It's an additional 550 days at the end of a very long sentence," he said.

"He's serving 18 years; he may get out after almost 15 years.

"To impose any additional burden upon him would, in my submission, have the potential of undermining and destroying prospects of rehabilitation."

Lacey's full-time release date was May, 2025, with earliest possible parole release in May, 2022

Justice Anthe Philippides said the "gravity of the offences" warranted further time.

She sentenced him to five years for trafficking, to be served concurrently with his manslaughter sentence.

But a further two-year jail term for the armed robberies, with a serious violent offender declaration, must be served on top of that sentence.

This means Lacey's new full-time release is May 11, 2027, which will make him eligible for parole in October, 2023.
