Murderer of man, whose penis was cut off, appeals verdict

A CONVICTED Maryborough murderer, who told police he dumped his victim's body in forest on the Sunshine Coast, has argued the guilty verdict against him should not be upheld.

Graeme Kenneth Wright, 44, was sentenced in March to life in jail for what was described in court as the "violent" and "abhorrent" murder of Noel Allan Clark, which also involved an accomplice cutting off his penis.

He had pleaded guilty to manslaughter, which the Crown would not accept, arguing he was caught up in the events of the night but was not an active participant.

Barrister Damian Walsh, who told the Queensland Court of Appeal he was acting pro bono, said his client was deprived of a not guilty verdict because the trial justice did not give appropriate directions in relation to "lies".

He said there were numerous versions of the events and the directions fell short of that required surrounding those versions.

Crown prosecutor Michael Byrne submitted the guilty verdict on the murder was always open to the jury, which obviously determined there was intent.

He said there was evidence Wright had shown antagonism towards Mr Clark, evidence of motive and ongoing hostility throughout the evening.

Mr Byrne said the defence case was "clever" and the suggestion someone else was calling the shots was a "viable theory" but the jury was not bound to accept it.

He argued Wright lured Mr Clark to the Maryborough house where he was killed and was involved in the violence.

During the trial, the Crown alleged the motive for the murder was Wright's obsession with his former girlfriend Kylie Mackney and her new relationship with Mr Clark, 33.

The Crown alleged Wright recruited Dianna Gay Wright (no relation) and Byron Naylor to help lure Mr Clark.

Wright allegedly wrapped electrical cords around Mr Clark's neck while Naylor hit him across the head with a bat.

The Court of Appeal has reserved its decision.
