Man accused of assaulting ex-girlfriend may face jail

A MAN has been remanded in custody while a Mackay Magistrate contemplates his fate.

Mackay Magistrates Court was told jail was within range for Brendon Jay Midwood.

Aged 32, he faced court yesterday for violence against his then-girlfriend almost 12 months ago.

The length of time between when the actual offending occurred and his court appearance might be one of the only things saving him from a term of imprisonment, the court was told.

Magistrate Damien Dwyer said wanted to consider the facts before handing down his sentence.

On February 8 last year about 1am the man and his partner were having an argument. She left the residence and he followed her outside.

Midwood hit her across the face, police prosecutor Constable Duncan Erskine said.

Midwood pleaded guilty to assault occasioning bodily harm and to wilful damage on February 7. The court was told he damaged a windscreen wiper on the woman's vehicle and also smashed one of the rearview mirrors.

Const Erskine said he was seeking $800 in compensation and restitution.

Duty solicitor Catherine Luck, of Taylors Solicitors, said both Midwood and the woman had been drinking with a large group and everyone was intoxicated.

He hadn't meant to damage the windscreen wiper he'd just been "fiddling" with it to make it work better.

During an argument with the women, he'd "thrown his arms out" and hit the rearview mirror. The court was told the woman had been holding a bottle at the time of the attack, but he accepted he had hit her in the side of the face.

The court was told Midwood had a "significant history", which included multiple breaches of domestic violence orders, prior assault occasioning bodily harm, assaulting police and breaching probation orders.

Mr Dwyer said he had done nothing to try to rehabilitate himself and was still continuing violence.

The matter was adjourned until today.
