Magistrate hits out at child sex case delays

A CITY magistrate has hit out at delays blocking a criminal case from proceeding through the court system.

Magistrate Graham Lee has demanded the police prosecution file a notice explaining the long delays in a child exploitation case which had been set to proceed to a higher court yesterday.

Solicitor Claire Graham, from legal firm Bosscher Lawyers, appeared on behalf of her client and sought an adjournment.

She told the court a brief of evidence had been received from the police, but was awaiting the results of a forensic analysis of her client's computer.

The man, 43, has been charged with one count of indecent treatment of a child under 16 (indecent film). The charge alleges the child was under 12 years and a lineal descendent. The man has not been required to enter any plea to the charge.

Ms Graham said the case would have to proceed by indictment to a higher court, but not until the computer analysis was received.

Police prosecutor Julia Wheaton said the forensic analysis of the computer was a "lengthy process" and could only be done in Brisbane.

She said the computer had been sent to Brisbane where it was to be analysed and the files accessed and downloaded before being entered into evidence.

In adjourning the matter to a later date, Mr Lee ordered a note be attached to the file explaining the delays in the analysis process.

Mr Lee said the accused's appearance at the next court date was excused.
