Indecent image sent to teen
A 15-YEAR-OLD girl went to the Mackay police station to dob in Norman Grosser after he sent her a picture of his penis.
Grosser was given the girl's phone number by a female friend and she received the indecent image on August 21, 2009.
The text accompanying the indecent image contained the words: "It's long John."
The 15-year-old girl contacted her female friend and told the friend to get Grosser to delete her phone number.
However, five days later, Grosser sent her a text message.
The girl went to the Mackay police station about one week later, spoke to a Child Protection Investigation Unit officer and made a formal complaint.
Police were able to check phone records and trace the picture and SMS to Grosser's phone, prosecutor Errica Fforde told the Mackay Magistrates Court yesterday.
Grosser was charged more than 12 months ago with exposing a child under 16 to an indecent image.
There have been lengthy adjournments to allow police and defence lawyers to agree on the circumstances of the offence.
The court was told yesterday that police asked Grosser why he had sent the picture and he claimed it was supposed to be sent to his girlfriend.
However, he could not explain why he made the mistake twice in a week.
Duty lawyer John Aberdeen, of Legal Aid Queensland, said Grosser insisted the sending of the image and text were accidents.
"I am instructed that the picture was not to be transmitted to anyone other than his partner," he said.
Sentencing was adjourned to August 30, to allow police and defence to agree on the facts, otherwise a disputed facts hearing will be heard later this year.
