Gang rape: Pair sexually assaulted teen as she threw up

TWO men have been convicted by a jury over the rape of a drunk teenage girl while she was being sick in the toilet.

Loyd Bandao, 22, and James Bruce, 29, were convicted by a jury of sexual assault in company for being present when another man Billy Joe Alcazar "ripped" the girl's pants off and raped her.

The jury, however, found both men not guilty of also sexually assaulting the 18-year-old while she was being raped by Alcazar.

The young woman was raped during a house party at Blacktown in Western Sydney on June 21, 2015.

The Crown alleged all three men sexually assaulted the woman at the same time while she was being sick in an outhouse toilet.

Alcazar had previously pleaded guilty to raping the woman and chose to give evidence against Bandao and Bruce in exchange for a reduced sentence.

He told the jury that the three of them entered an outhouse toilet where the intoxicated woman was "spewing" in the toilet.

"I ripped her pants off she turned around and started smoking (having oral sex) with Loyd and I started rooting her," he told the trial.

Billy Joe Alcazar, who was 19 at the time of the rape, said he “ripped” a girl’s “pants off” and began “rooting her”. He has pleaded guilty to rape.

He said he thought she was consenting because, "she never said stop or anything."

The woman gave evidence that after the attack she crawled naked from the toilet and passed out.

After two and a half days of deliberation the jury returned a verdict of not guilty to two counts of aggravated sexual assault in company but guilty to a third count of sexual assault in company.

Bruce was granted bail ahead of his sentencing hearing while Bandao continued to be remanded in custody.

The case will return to court for mention tomorrow.
