Driver fined for playing muppets

A WOMAN'S impromptu Muppet show received a bad review in Hervey Bay Magistrates Court yesterday.

Angela Mary Dorian, 47, pleaded guilty to a charge of driving without due care and attention, after being pulled over for entertaining her son with a Muppet toy while driving on June 2.

Police prosecutor, Senior Constable Jeanette Grigoris, said a police patrol in Torquay at 2.45pm observed Dorian continually turning her attention away from the road, while playing with the Muppet.

Dorian was charged for “not paying proper attention to other cars on the road”, said Snr Const Grigoris.

Dorian's solicitor, John Milburn, asked the court to treat the case with “the level of criminality it deserves”.

Mr Milburn said his client was driving safely as she entertained her three-year-old son along the Esplanade, and was not speeding or swerving about the road.

“Many people drive while changing CDs,” Mr Milburn said, arguing that simply not having your full attention on the road rarely resulted in being charged.

Mr Milburn also entered a guilty plea on behalf of Dorian for a charge of unlicensed driving, which the court heard related to her failing to change from a Victorian licence to a Queensland licence.

Magistrate Graeme Tatnell said someone would not normally get into trouble for amusing a child, but that it was important to think of the safety of other road users.

Mr Tatnell fined Dorian $350, however he did not take any action in relation to her licence.

The identity of the Muppet in question was not revealed in court yesterday.
