Doctor banned after relationship with married patient

A FRASER Coast doctor who had an affair with one of his patients has had his licence suspended for two years.

The Queensland Civil and Administrative Tribunal heard Dr Stephen Gilliland denied having a two-year affair with the patient despite overwhelming evidence to the contrary.

The tribunal heard the two had known each other for several years and the patient saw the affair as a genuine relationship and did not feel as though she was exploited.

Judge Julie Dick said, when handing down her decision, it was the doctor's duty, not the woman's, to maintain the appropriate professional boundaries.

She said there was no evidence to suggest the doctor's professional care to the patient and her family was not of good quality.

"He breached not only his duty to the patient but to her husband and her children who were also his patients," she said.

"References from three doctors speak to the fact that he is well regarded by his peers and that he has provided good service to the community.

"He has denied the affair in the face of compelling evidence and his conduct of the proceedings has required the patient to give evidence and submit to attacks on her character and credibility.

"His conduct of the proceedings demonstrates a lack of remorse and a preparedness to misrepresent the truth to his professional body."

Judge Dick ordered Dr Gilliland be reprimanded for his actions and suspended his registration for two years from January 16 this year.

She also ordered Dr Gilliland to pay the Medical Board of Australia's costs incurred during the proceedings.
