Clive Palmer back in court, other Clive appeals to avoid it

GLOBETROTTING Clive Mensink is appealing a warrant issued for his arrest as his uncle Clive Palmer is set to be grilled in court today about his whereabouts.

Mr Mensink has asked the Federal Court to set aside the warrant, which was issued in March after he dodged two court orders to give evidence about the company's collapse last year with $300 million in debts and 800 job losses.

The appeal, which will be mentioned in the Federal Court tomorrow, argues there was no evidence the former QNI director had notice of orders made on December 15 and February 27 requiring the businessman to return to Australia to give evidence.

It is also claimed the judge did not adequately consider whether he had "reasonable cause" for not attending the public examination, and there was no basis to conclude he was likely to abscond.

It is unclear how Mr Mensink's lawyers received instructions to launch the appeal, as they previously claimed to have lost contact with him while he is overseas enjoying a holiday that started last June.
