Judge takes time out after horrific child porn
A QUEENSLAND judge has delayed sentencing a serial sex offender who repeatedly raped a two-year-old girl, after finding the recording of the acts so horrific it could "overwhelm" her decision.
Convicted paedophile and Gold Coast yoga teacher, Jason Daron Mizner, 44, is being sentenced in the Brisbane District Court after pleading guilty to more than 60 child sex offences involving the two-year-old girl in the early 2000s.
The offences relate to repeatedly raping, assaulting and videotaping the baby by Mizner on the Gold Coast more than a decade ago.
The court heard the offending was uncovered when Mizner, then 31, had left the home to go on holiday to Thailand and he left a bag with some possessions in Australia.
Recording of the child were found together with a folder with pages containing the of names of children and several handwritten notes detailing "how to target and kidnap children for child exploitation material".
By the time the shocking discovery was made, Mizner had decided to stay in Thailand and formed a relationship with a local woman before sexually assaulting her baby daughter soon after arriving.
He was convicted of the shocking child-sex offences and served 11 years of a 35-year sentence in a Thai jail.
Mizner was arrested by Australian authorities when he arrived back in Brisbane after being released.
The court was today told the 44-year-old had filmed himself having sex with the Australian child on several occasions.
Crown prosecutor Sarah Farndon asked Judge Leanne Clare to view the distressing recordings saying: "Words can't sufficiently describe the offending conduct".
"It is difficult to put into words the distress of the complainant," she said.
"It really is something that needs to be seen to be believed and the violence, which accompanies the offence… it's difficult to express that sufficiently."
Judge Clare, who is a former Queensland Director of Public Prosecutions, told Ms Farndon: "Surely I don't have to see them".
"I really don't want to look at any," she later said but agreed to view the most horrific portions of the hour-long tapes.
The court heard a psychologist had prepared a report that described Mizner as having "entrenched deviant sexual arousal" and called him a "predatory" and callous rapist.
Judge Clare said it also showed he had a "predilection for babies" and had a medium-to-high chance of reoffending if not incarcerated.
"Even a low risk of reoffending when it comes to raping babies is a substantial risk to deal with. When it's a medium-to-high risk... it's alarming," she said.
After viewing the recordings, Judge Clare returned to court and adjourned the sentence until later this week, saying she was concerned the emotion of seeing the recordings could "overwhelm" her judgment.
"I did look at a portion of the tape that was provided and I think that it would be best to put some distance between the viewing of that tape and the delivery of the judgment, so that it does not overwhelm the sentence," she said.
"It is very confronting material and I don't wish it to distort a just sentence."
Ms Farndon on Tuesday asked for Mizner to be sentenced to life behind bars.
His defence team argued his sentenced should be reduced to 18 years the fact he had pleaded guilty to the offences and already served time in jail in Thailand.
He will be sentenced on Friday.
