Bail denied in shooting case

LIAM Thomas McMahon allegedly told residents in a Berserker St home he had a gun and wasn't afraid to use it, a court heard yesterday.

The Rockhampton Magistrates Court was told McMahon, 20, had been on a 16-hour drinking binge when he allegedly threatened the residents in the early hours of Tuesday morning.

Several shots were later fired into the garage of a home across the road, while its occupants were having breakfast.

Magistrate Annette Hennessy refused McMahon's bail application.

He faces five charges under the weapons act.

Police prosecutor Constable Paige Barrow said McMahon told police he was the last person they would want in possession of a gun.

"It was good luck, not good management that no one was injured or killed," Const Barrow said.

She said McMahon and a friend had been on a long drinking session in Keppel Sands before driving to Rockhampton where the residents were threatened with a 12-gauge shotgun.

Const Barrow said McMahon was on bail in relation to another matter at the time of the alleged incident in Berserker St.

She said he had made admissions consistent with witness statements, further threats during police interviews and threatened witnesses.

McMahon's defence lawyer asked Ms Hennessy to take into consideration that McMahon was heavily intoxicated at the time of the alleged incident, had no previous history of firearms offences and the firearm allegedly used to threaten the Berserker St residents had not been loaded.

He also said McMahon had no history in the use of weapons and it appeared his friend was the instigator of the offences.

Ms Hennessy said McMahon posed a substantial risk of committing further offences and endangering the public.

The matter has been adjourned to July.
