Assault conviction after racial slur

A 22-year-old Gympie man who tried to march his neighbour off his property after she called him a "nigger" was convicted of assault this week.

Michael Anthony Burns pleaded guilty to common assault and was put on a six month good behaviour bond on a recognisance of $400.

Gympie Magistrates Court heard the March 8 dispute began when Burns' female neighbour complained about the loud music being played.

About an hour later she went over to where Burns was, "came up very close to him, pointed her finger at him and yelled", the court was told.

"She called him a nigger."

Burns walked over to the woman, turned her around and she started to walk away, but then fell to her knees.

Burns had been a bit "overzealous" but had not meant for that to happen, his lawyer said.

"There appears to have been some provocation."

Magistrate Maxine Baldwin advised Burns to stay away from the woman who made the complaint against him.
