Anger led to ‘keying'

RUNNING a sharp object along the side of a car, causing "a long, deep scratch", resulted in a wilful damage charge heard in Gympie Magistrates Court yesterday.

Francis Michael Bennett, 48, of De Castella Rd, pleaded guilty to the October 27 offence and was ordered to pay $407 restitution.

Police prosecutor Senior Constable Lisa Manns said on January 18, when Bennett was at the police station, he said the complainant had been "yelling abuse at him" on the day of the offence.

Duty solicitor Leanne Gordon told the court her client used to work for the complainant and that there were family matters involved.

"Both parties are unable to let go of bad blood," Ms Gordon said. She said her client was in Young St and the complainant was in the car after the offence had taken place and not walking toward the vehicle as the complainant had stated.

"My client is very angry at the complainant. He admits he damaged the car, but the complainant fabricated the story to ensure my client was pinned for the offence," she said.

Magistrate Maxine Baldwin told Bennett "these things tend to get dirty and ugly". She fined Bennett $200, with three months to pay restitution.
