Wrong bloke hit, but $2000 fine sticks

A DRUNKEN Clinton John Hughes punched a man outside a Toowoomba pub for which he copped a $2000 fine.

Turned out he actually punched the wrong bloke in the first place, Toowoomba Magistrates Court heard.

Hughes, 29, had been arguing with one of two men outside the Norville Hotel about 11pm, January 29, the court heard.

His solicitor Chris Lumme told the court CCTV footage of the incident showed his client being felled by a blow from a man who then walked back inside the hotel.

Dazed, his client had then got up from the footpath and punched a man standing nearby who he had thought was the culprit who had decked him, Mr Lumme submitted.

Police prosecutor Des Neijens told the court the victim had sustained a cut lip and bruising to his face.

Hughes pleaded guilty to assault occasioning bodily harm and public nuisance.

Magistrate Damian Carroll told Hughes "alcohol fuelled violence will not be tolerated" and fined him $2000.
