Man wants drivers licence back to go fishing, care for mum

"HE wants to buy a boat and go fishing".

It may not sound like an uncommon dream, but for Robert van Kuik, his dream will rest upon the decision of Magistrate Cameron Press on Friday morning.

Mr van Kuik was sentenced to an absolute licence disqualification in 2000, meaning he would never be eligible to hold a licence again.

But now he is in the Rockhampton Magistrates Court asking for that to be overturned.

And that comes 16 years after the initial sentence.

Van Kuik's defence solicitor Allan Grant said van Kuik had not been a model citizen for those 16 years and had been charged for various driving offences.

Police prosecutor Senior Constable Manon Barwick said van Kuik "is still... not a fit and proper person to hold a drivers' licence".

In 2013 van Kuik received a wholly suspended jail sentence for driving while disqualified - only one year after he was caught drink driving in 2012 with a BAC of 0.113%.

Mr Grant also said van Kuik wanted his licence back to care for his mother and also for his employment.

Magistrate Cameron Press expressed doubt as to whether van Kuik would have the sentence lifted.

"He drives disqualified in October 2012 with alcohol in his system and then in April 2013 he is back driving while disqualified when he was already disqualified absolutely," Mr Press said.

When asked by Magistrate Press about van Kuik's criminal history, Snr Const Barwick said it was "concerning".

"It does have a number of entries after 2000 for drug related offences, public nuisance and fraud," Snr Const Barwick replied.

Magistrate Press will hand down his decision at 9am on Friday.
