Man in court again over drugs

Tags: cannabis, court, drugs, probation

PLEADING guilty to possessing a dangerous drug and utensils and producing a dangerous drug caused a Gunalda man to breach his probation.

Gympie Magistrates Court heard this week Billy-Joe Carter, 30, of Anderleigh Rd, was placed on probation for two years on September 21, 2011.

Police prosecutor Senior Constable Lisa Manns told the court that a search warrant was executed at Carter's home on February 9 in relation to another matter when they smelt burnt cannabis.

"The defendant said he'd smoked some about an hour before police arrived," she said.

Police found about one gram of dried cannabis and two pots with plants between 3cm and 10cm which Carter said he'd planted about a fortnight previously.

Community Corrections asked for Carter to be fined for breaching his probation and for the probation order to continue as it still had 18 months remaining.

Carter was placed on good behaviour bond of $300 for four months.

His probation was extended for two years and he was fined $200 for the breach.
