SEATED in the driver's seat with the keys in the ignition, Nathan John Kirwin, 31, was unpleasantly surprised when police officers tapped on the window and breathalysed him.

His blood alcohol concentration (BAC) was .068 per cent and he was charged with being in charge of a motor vehicle while over the legal limit on Exhibition Road, June 27.

He told Gympie Magistrates Court that he had hopped into his car to listen to music on the stereo.

While perusing his driving history, Magistrate Maxine Baldwin commented that Kirwin had the heaviest foot she had seen in a while but mentioned he had never been charged with drink driving before. Kirwin, of Hilton Road, Gympie, lost his licence for one month and was fined $200.

Stephen Keith Doyle, 24, drove on Tin Can Bay Road with an illegal BAC of .067 per cent on June 26.

Mrs Baldwin said the offence appeared completely out of character and awarded him a restricted licence for the purpose of getting to and from work for two months. Doyle, of Cooloola Cove, was fined $200.
